Ngongo v. Canada ( Minister of Citizenship and Immigration )

IMM-6717-98

Tremblay-Lamer J.

25/10/99

10 pp.

Application for judicial review of CRDD decision applicants not Convention refugees-Applicants, citizens of Democratic Republic of Congo (DRC), alleging fear of persecution for reasons of political opinion and membership in particular social group, family-Links with Kabila's people's revolutionary party-Applicants' Convention refugee claim dismissed in Sweden-CRDD found applicants' claim not credible and not enough evidence to establish well-founded fear of persecution in event of return to DRC-Application allowed-No reason to set aside CRDD decision for not having confronted applicant over major contradiction in testimony-Factors serving as potential guidelines in determining whether contradiction should be brought to claimant's attention-However, CRDD erred in disregarding possibility applicant's activities in Canada might give rise to negative reaction on part of DRC authorities and thus to reasonable chance of persecution in event of return (see Manzila v. Canada (Minister of Citizenship and Immigration), [1998] F.C.J. No. 1364 (T.D.) (QL)).
