Appeal from Federal Court decision (2005 FC 1551) duty under Access to Information Act, R.S.C., 1985, c. A-1, s. 25 to sever portions of documents containing information for which no exemption claimed extending to body of privileged communication—S. 25 not requiring information forming part of privileged solicitor-client communication (Act, s. 23) to be severed from balance of communication—Not Parliament’s intention to require disclosure of material revealing precise subject of communication, factual assumptions flowing from legal advice—Blank v. Canada (Minister of Justice), [2006] 2 S.C.R. 319 distinguished as that decision dealing with litigation privilege, not legal advice privilege—No legal duty for Minister to explain why solicitor-client privilege not waived—Appeal allowed in part; cross-appeal allowed in part.
