Human rights-Application for order prohibiting Human Rights Tribunal from conducting hearing into allegation Gordon Band Council discriminated against respondent Laslo by denying her residential accommodation on basis of sex, race or marital status-Application based on Canadian Human Rights Act, s. 67 providing nothing in CHRA affecting any provision of Indian Act-Application dismissed-On authority of Attorney General of Canada v. Cumming, [1980] 2 F.C. 122 (T.D.), order may issue on this ground if it comprises clear and severable question of law upon facts not in dispute-However, in present case, conflict of evidence on why housing denied to Laslo-For respondents to make proper argument, findings of fact need to be made which can only be done on full hearing of evidence-Application of CHRA to Laslo's complaint not presenting clear and severable question of law upon facts which are not in dispute-Canadian Human Rights Act, R.S.C., 1985, c. H-6, s. 67.
